Raja Petra detained....



May Allah open the heaven to shower him with lots of guidance - hidayah and love.
Lets pray for his strengh and courage so long as he serve as political prisoner.

I strongly disagreed with the manipulation of ISA by reason to protect Islam. As the facts shown there are a lots of avenues in terms of legal action may be taken. Why not A-G make a charge in the court of laws by using Syariah Enactments? Let me remind all of us that this kind of reaction will TARNISH THE IMAGE OF ISLAM. Nationwide will see the dictatorship of Islam potrayed by government despite it is too far from being existed by Prophet SAW.

Who Killed Count Folke Bernadotte?


I'm preparing for intellectual debate of my Public International Law lecture regarding to the admissibility of United Nations to initiate legal proceedings against any de jure or de facto states.

World Court had affirmed such right to be held by United Nations in the case of Reparations For Injuries Suffered In The Service Of United Nations.

The issue is what was the reason behind the admissibility of UN to bring international claims against the states? As the facts had shown, Count Folke Bernadotte - Chief United Nations Truce Negotiator was assassinated in Jerusalem.


Bernadotte's plan
called for the Jewish State to relinquish the Negev and Jerusalem to Transjordan and to receive the western Galilee. He insisted in the proposal that the right of the Arab refugees to return to their homes in Jewish-controlled territory at the earliest possible date should be affirmed by the United Nations. This proposal was completed on September 16, 1948 in consultation with British and American emissaries. Bernadotte advocated a total demilitarization of Jerusalem and blamed the Jewish forces for "aggressive" behavior in the city.




LEHI - Lohamei Herut Israel ("Fighters for the Freedom of Israel") was a Jewish extremist group, also called the "Stern Gang", engaging in a campaign of "personal terror" against the British in Palestine. For LEHI, Count Folke Bernadotte, as UN mediator for "Palestine," came to symbolize the foreign oppression of the Jewish claim to the Land of Israel. LEHI called Bernadotte a British agent and said he had cooperated with the Nazis in World War II.

The organization considered his plan to be a threat to its goal of an independent Israel with expanded territory on both sides of the Jordan River. Bernadotte was assassinated by a LEHI team in Jerusalem on September 17, 1948, an act that resulted in the elimination of the LEHI organization by the Jewish leaders of Israel.

PANEL Program Dialog Pindaan Akta Universiti dan Kolej Universiti (AUKU) yang berlangsung di Universiti Islam Antarabangsa Malaysia (UIAM) baru-baru ini sepakat mengakui akta itu adalah undang-undang 'drakonian' yang memenjarakan kebebasan mahasiswa.

Program dialog disertai panel kalangan ahli Parlimen dari tiga parti politik iaitu Ahli Parlimen Temerloh, Datuk Saifuddin Abdullah (Umno); Ahli Parlimen Balik Pulau, Mohd Yusmadi Mohd Yusuff Ahli (Parti Keadilan Rakyat), Salahuddin Ayub (Pas) dan wakil mahasiswa, Muhammad Faisal Abdul Aziz sependapat kewujudan undang-undang berkenaan melemahkan usaha membentuk barisan pelapis kepimpinan negara pada masa depan.

Pengarah program, Ahmad Fahmi Mohd Samsuddin, berkata penganjuran dialog itu bertujuan membuka mata ramai mahasiswa mengenai rang undang-undang itu.

Katanya, pada sesi dialog yang berlangsung selama tiga jam itu, rata-rata ahli panel memberi pelbagai pandangan dan ulasan masing-masing berkaitan AUKU.


“Keperluan undang-undang itu dipinda turut diperkatakan termasuk gesaan untuk memansuhkannya yang dilihat menyekat kebebasan mahasiswa terbabit secara langsung dalam proses pembangunan negara seperti ditegaskan Salahuddin.

“Yusmadi pula menekankan kepada aspek perundangan dan falsafah AUKU yang menyarankan agar mahasiswa kini tidak terikat dengan orientasi lama yang mana gerakan mahasiswa mengikut hirarki atau berpusat berbanding kini yang bersifat horizontal,” katanya.
Ahmad Fahmi berkata, tiga jenis orientasi gerakan mahasiswa iaitu aktiviti, bakti dan advokasi dijelaskan Saifuddin yang berpendapat advokasi sebagai ciri utama membezakan mahasiswa dengan pelajar sekolah tetapi dihalang AUKU.

Katanya, Saifuddin turut menjelaskan undang-undang mahasiswa itu sudah melalui banyak pindaan namun sesetengah bahagian yang tidak dipinda kini menjadi isu utama pelbagai pihak.

“Muhammad Faisal pula menegaskan mahasiswa memerlukan kebebasan dalam mendewasakan dan mematangkan diri bagi menghadapi cabaran dunia sebenar,” katanya.

Dialog isu kontroversi dipengerusikan Mohd Saifullah Zulkifli diselang seli dengan jenaka dan sindiran berbaur politik yang mengundang gelak tawa hampir 600 hadirin kalangan mahasiswa, ahli akademik, pentadbir universiti dan wakil badan bukan kerajaan (NGO).

Program dialog itu diadakan di Auditorium Utama, UIAM anjuran Badan Perwakilan Pelajar Mahallah As-Siddiq dengan kerjasama Kelab Intelektual Muda dan Sekretariat Akademik dan Penyelidikan, Persatuan Ekonomi dan Sains Pengurusan, UIAM.

"Pendatang" : Jus Soli vs Jus Sanguinis

I am not particularly interested in the recent development of political scene. The controversial and offensive remarks issued by Bukit Bendera Umno Chief Division Dato Ahmad Ismail still being highlighted by media constantly without presenting any efforts to find amicable solutions to this racial dissent.

Worse still, many Chinese leaders keep urging Ahmad himself to make a public apology regarding to the remark. According to them Dato Ahmad Ismail alone should take responsibility for his action. Not long after, it was followed by a very fresh incident caused by UMNO as responding to the apology demand.

Media had reported the harsh feedback had been made by UMNO by pulling down the photo of ex-CM Dr Koh Tsu Koon from the wall of UMNO HQ and tearing it into half. Eventually, the feedback have led to the immediate decision of Penang Gerakan to severe ties with UMNO in the island state.

Rationally, should we agree that this 37% of Malaysian population is made up of "Pendatang"?

I divided the issue into historical and current perspective. In historical perspective for sure I will be in line with him. Historical facts had clearly shown the migration of Chinese to Tanah Melayu. Even, before Merdeka, Malay leaders had compromised a lot to accept them which previously called as immigrant to participate as Malaya citizen by adopting "jus soli" principle. Meanwhile, in the same time, they were willing to share the nations together by neglecting the doctrine of "jus sanguinis" even though it was the common practice of all newly independent states in the world around 1940s and 1950s and acknowledged by International law.


Jus soli defined by Oxford Dictionary of Law as the rule by which birth in a state is sufficient to confer nationality, irrespective of the nationality of one’s parents. In a simple word, the doctrine is accepting all those who were born in state as citizen without concerning their ascendant. Ironically, jus sanguinis is defined as the principle that the nationality of children is the same as that of their parents, irrespective of their place of birth. In other word, it is regarding all descendant of immigrant as non citizen despite they were born in the state. The later was bringing the effect of repatriation process to all "pendatang". Uganda for instance, before gaining independence had stipulated 3 months to all immigrant whether to return to their original country or assimilate with the local customs and influences. Again, Malaya is the only one country in the world departed from this international law principle without any elements of coercion or undue influence by British.

But, by looking at the current perspective the historical argument seems to be fragile. Now we are living in more than 50 years age of Malaysia and the principle of equal citizenship prevail. Thus, no doubts that all Malaysians should be treated as citizen. Nevertheless by hook or by crook, the history part should be kept continuously by all quarters particularly in maintaining the prosperous life of Malaysia.

I opined that the major concern is not about "pendatang" and apology, but the conflict of interests between Malays and Chinese. Both claimed of their authentic rights in many fields had been seized and marginalized. So, this "racial impasse" had to be solved at first. Most of them respectively believing of living in unfair society due to poverty or financial problems faced. My suggestion is, we must look forward for the betterment of Malay and Chinese in making concrete decision. The essence of good governance that is policy of equality should be upheld in helping those who suffered and live in a miserable condition.

Hence, we must have a new language of discourse by looking the problems as collective responsibility. Now it is irrelevant to confine the problem to one particular ethnic group by labelling it as Malay or Chinese problem but the perspective must be shifted to people problem. We must speak up and act on behalf of Malay, Chinese, and Indian heartland.

Meanwhile, whichever way you look at it, the nation policy upheld must be in a position of respecting history without putting aside the contributions of our forefathers particularly in drafting "Social Contract" which later embedded in Article 153 of Federal Constitution.

Accepting the doctrine of jus soli is a price to be paid by Malay leaders in order to get privileges acknowledged in Social Contract or Article 153 of Federal Constitution. If we are not respecting the element of "Social Contract" or Article 153 of Federal Constitution, this kind of "hot button issue" will reach the deadlock forever. So why should this kind of respect be so difficult for us?

SALAM RAMADHAN AL-MUBARAK



Di kesempatan ini, saya ingin menyusun sepuluh jari memohon maaf kepada ibu bapa dan keluarga, seluruh rakan-rakan, sahabat-sahabat serta kepada semua yang mengenali diri saya dan selamat menunaikan Ibadah Puasa 1429 Hijrah. Sentiasalah berjiwa besar dan pertahankan idealisme sepanjang bulan mulia ini. Semoga Ramadhan ini akan mengangkat martabat seluruh pimpinan PKPIM dan mengembalikan jatidiri perjuangan pelajar Islam seluruh dunia. HIDUP BIAR BERJASA.

Dialog AUKU: Satu Coretan Sejarah

Tanggal 29 Ogos 2008, merupakan satu tarikh keramat dalam sejarah gerakan mahasiswa apabila UIAM bersama-sama dengan PKPIM telah berjaya mencoret suatu sejarah yang bermakna apabila berjaya mengenengahkan tiga orang politikus dalam suatu dialog bersama mahasiswa berhubung pindaan Akta Universiti dan Kolej Universiti (AUKU), di Main Auditorium, UIAM.

Sebelum itu, tahniah diucapkan kepada Sdr Fahmi selaku pengarah program yang juga merupakan Exco PKPIM dan seluruh jawatankuasa penggerak yang bertungkus lumus menjayakan program ini. Penghargaan juga dirakamkan kepada Intelectual Youth Club (IYC), Mahallah Sidiq, dan Economics Society yang telah menyumbang.

Tahniah juga diucapkan kepada Sdr Saifullah Zulkifli yang telah bejaya mengelola dialog ini dengan terbaik sepanjang menjadi moderator.

Dialog yang bermula jam 9.00 malam itu dihangatkan dengan kelantangan empat orang penalis iaitu YB Dato Saifuddin Abdullah (Timbalan Menteri) yang mewakili BN, YB Yusmadi Yusof (MP Balik Pulau) yang mewakili PKR, YB Salehudin Ayob (MP Kubang Kerian) yang mewakili PAS, dan Sdr Muhammad Faisal Abdul Aziz (saya)yang mewakili mahasiswa-PKPIM.

Kesan langsung dari dialog ini jelas memperlihatkan masih ramai mahasiswa yang berkesedaran berhubung isu yang menyelubungi kelompok mereka ini. Dialog ini juga berjaya mempertemukan titik persamaan keempat-empat panelis berhubung pandangan mereka tentang AUKU.

Diharap dialog ini tidak terhenti di sini sahaja. Usaha yang lebih kehadapan dan konsisten perlu digapai oleh kita selaku penggerak gerakan pelajar untuk memastikan gerakan kita tidak terus terkubur.
